You should keep your login and password information safe and treat such information as confidential. You must not disclose it to any third party. We are the owner or the licensee of all intellectual property rights in the BecomingX Platform and all material published in connection with it with the exception of Your Content (as defined and detailed below). The BecomingX Platform is protected by copyright laws and all such rights are reserved to BecomingX.
You must not copy, modify or download any part of the content on the BecomingX Platform without obtaining a licence to do so from us or our licensors (which we may refuse to grant). There may be occasions where we expressly permit you to download content for free or as part of a subscription, where this is the case this will be made clear on the BecomingX Platform.
If you print off, copy or download any part of the BecomingX Platform in breach of these Terms of Use, your right to use the BecomingX Platform and/or be provided with any goods will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
Your Content means any content that you submit or transmit to, through, or in connection with the BecomingX Platform such as ratings, reviews, compliments, invitations, check-ins, messages, and information that you publicly display or displayed in your account profile. Provided you have created or own the rights to the content you retain all of your ownership rights for Your Content. However, we may use Your Content in a number of different ways, including publicly displaying it, reformatting it, incorporating it into advertisements and other works, creating derivative works from it, promoting it, distributing it, and allowing others to do the same in connection with their own websites and media platforms and any other media channel now known or hereafter discovered or developed (Other Media) which use may occur while you are a user or anytime thereafter. Your Content may be made public without any additional notice to or consent by you and you should assume that any person may read Your Content. Even if Your Content is removed from the BecomingX Platform, BecomingX may retain Your Content in backups indefinitely and Your Content may be cached in search engine indices after removal and BecomingX has no control over such caching. By submitting Your Content to BecomingX, you hereby grant BecomingX a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the BecomingX Platform (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the BecomingX Platform (and derivative works thereof) in any Other Media. You also hereby grant each user of the BecomingX Platform a non-exclusive license to access Your Content through the BecomingX Platform, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the BecomingX Platform and under these Terms of Use. You irrevocably waive, and cause to be waived, against BecomingX and users any claims and assertions of moral rights or attribution with respect to Your Content. By "use" we mean use, copy, publicly perform and display, reproduce, distribute, modify, translate, remove, analyse, commercialise, prepare derivative works and otherwise exploit Your Content.
You shall indemnify BecomingX against all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other reasonable professional costs and expenses) suffered or incurred by BecomingX arising out of or in connection with any claim made against BecomingX for actual or alleged infringement of a third party's intellectual property rights arising out of or in connection with Your Content.
Trademarks: "BecomingX" and all other names, logos, and icons identifying BecomingX and its programs, products, and services, including any logos, page headers, icons, designs, or trade dress and whether not appearing in large print or with an accompanying symbol, are proprietary trademarks of BecomingX and are protected from reproduction, imitation, dilution, or confusing or misleading uses under national and international trademark and copyright laws. Other product and company names mentioned herein may be the trademarks and/or service marks of their respective owners. The use of any trademarks contained on the BecomingX Platform without the express written permission of BecomingX is strictly prohibited, and nothing stated or implied on the BecomingX Platform confers on you any license or right under any trademark of BecomingX or any third party.
The BecomingX Platform is made available to you on an "as is", "with all faults" and "as available" basis. As such, your use of the BecomingX Platform is at your own discretion and risk. BecomingX makes no claims or promises about the quality, accuracy, or reliability of the BecomingX Platform, its safety or security, or the BecomingX Platform content. Accordingly, BecomingX is not liable to you for any loss or damage that might arise, for example, from the BecomingX Platform's inoperability, unavailability or security vulnerabilities. Although we make reasonable efforts to update the information on the BecomingX Platform, we make no representations, warranties or guarantees, whether express or implied, that the content on the BecomingX Platform is accurate, complete or up to date.
To the extent permitted by law, BecomingX expressly disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. No oral or written information or advice provided to you by a representative of BecomingX shall create a representation or warranty. Without limiting the foregoing, BecomingX does not warrant or make any representations (i) that the BecomingX Platform and any downloadable software, content, services, or applications made available in conjunction with or through the BecomingX Platform will be uninterrupted or error-free, that defects will be corrected, or that the BecomingX Platform and any downloadable software, content, services, or applications made available in conjunction with or through the BecomingX Platform or the server that makes them available are free of viruses or other harmful components, or (ii) regarding the use of the BecomingX Platform and any downloadable software, content, services, or applications made available in conjunction with or through the BecomingX Platform in terms of correctness, accuracy, reliability, or otherwise. Any material or data that you are permitted to download or otherwise obtain through the BecomingX Platform is at your own risk. You are solely responsible for any damages to your computer system or loss of data resulting from the download of such material or data.
Your sole and exclusive right and remedy in case of dissatisfaction with the BecomingX Platform, related services, or any other grievance shall be your termination and discontinuation of access to, or use of, the BecomingX Platform.
BecomingX is not an agent of any third-party provider. BecomingX makes no claims or promises with respect to any third party, including our information sharing partners or any businesses or advertiser listed on BecomingX Platform. Accordingly, BecomingX is not liable to you for any loss or damage that might arise from the actions or omissions of such third parties, including, for example, if another user or business or individual misuses your content, identity or personal information.
Where the BecomingX Platform contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.
We exclude all implied conditions, warranties, representations or other terms that may apply to the BecomingX Platform or any content in connection.
We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

We do not guarantee that the BecomingX Platform will be secure or free from bugs or viruses.
You are responsible for configuring your information technology, computer programmes and platform to access the BecomingX Platform. You should use your own virus protection software.
You must not misuse the BecomingX Platform by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the BecomingX Platform, the server on which the BecomingX Platform is stored, or any server, computer or database connected to the BecomingX Platform. You must not attack the BecomingX Platform via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the BecomingX Platform will cease immediately.
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

When we consider that a breach of these Terms of Use has or may occur, we may take such action as we deem appropriate which may include, but not be limited to, taking all or any of the following actions:

By sending us any ideas, suggestions, documents or proposals (Feedback), you agree that (i) your Feedback does not contain the confidential or proprietary information of third parties, (ii) we are under no obligation of confidentiality, express or implied, with respect to the Feedback, (iii) we may have something similar to the Feedback already under consideration or in development, and (iv) you grant us an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, modify, prepare derivative works, publish, distribute and sublicense the Feedback, and you irrevocably waive, and cause to be waived, against BecomingX and its users any claims and assertions of any moral rights contained in such Feedback.
Closing your account: You may terminate your account by emailing us on support@becomingx.com. Please review our Privacy Policy for information about the effect of account termination on our use of the data we have collected from you. Please keep in mind that it may take up to ten business days to complete the termination of your account.
Losing Rights to the BecomingX Platform: We may close your account, suspend your ability to use certain portions of the BecomingX Platform, and/or ban you altogether from the BecomingX Platform for any or no reason, and without notice or liability of any kind. Any such action could prevent you from accessing your account, the BecomingX Platform, or any other related information.
Terms Continue After Termination: In the event of any termination of these Terms of Use, whether by you or us, these Terms of Use will continue in full force and effect.
Any failure on BecomingX’s part to exercise or enforce any right or provision of these Terms of Use (or any other terms) does not constitute a waiver of such right or provision. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder.
If any provisions of these Terms of Use are found to be unenforceable or invalid, then only that provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary so that the Terms of Use shall otherwise remain in full force and effect and enforceable.
These Terms of Use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law and under the exclusive jurisdiction of the English courts.

Please note depending on the change(s) you may not be due any refund for your BecomingX Education subscription in this instance.
BECOMINGX EDUCATION SUBSCRIPTION
Details of the BecomingX Education subscription and the benefits you can receive can be found on the BecomingX Platform.
BecomingX Education Subscription. To take out a BecomingX Education subscription you must:
BecomingX reserves the right to reject your BecomingX Education subscription at its sole and absolute discretion without reason.
Subject to compliance with these Terms & Conditions and all other terms in connection with the BecomingX Platform and in particular receipt of full payment of your BecomingX Education subscription, you are granted during the term of your BecomingX Education subscription a non-transferable, non-exclusive, non-sublicensable licence to the BecomingX Platform for educational and non-commercial use only. This licence includes the ability to use of all films available on the BecomingX platform for educational purposes. You understand that your use of the BecomingX Platform does not confer to you any intellectual property rights held by BecomingX and/or its licensors. You are merely given a licence to use the BecomingX Platform in connection with your BecomingX Education subscription in accordance with these Terms & Conditions and the Terms of Use.
YOUR OBLIGATIONS
By taking out a BecomingX Education subscription you agree the following:
Own risk. You use your BecomingX Education subscription at your own risk and are solely responsible for any interactions through the BecomingX Platform.
Provided on an “as is” basis. Your BecomingX Education subscription is provided on an “as is” basis and we disclaim to the fullest extent permitted by law all warranties, express or implied, statutory or otherwise. Specifically, we make no representations, warranties or guarantees about the following:
Availability of the BecomingX Platform. We may discontinue or make changes to the BecomingX Platform at any time. If this has a material impact your BecomingX Education subscription you may be entitled to a refund. We do not guarantee that your BecomingX Education subscription or the BecomingX Platform will be available at all times and on an uninterrupted basis.
Password. When you take out your BecomingX Education subscription you will be asked to create a password for your BecomingX Education subscription account. You are solely responsible for all activities that occur under your BecomingX Education subscription account and for maintaining the confidentiality of your BecomingX Education subscription account and password, payment information you use in connection with your BecomingX Platform, and for restricting access to your computer or any device which you use to access the BecomingX Platform. You agree to accept responsibility for all activities that occur under your BecomingX Education subscription account. If you have reason to believe that your account is no longer secure (for example, in the event of loss, theft or unauthorised disclosure) you are required to immediately notify us. You may be liable for the losses incurred by us or others due to any unauthorised use of your BecomingX Education subscription account. BecomingX shall under no circumstance be liable for any loss or damage arising from your failure to keep your BecomingX Education subscription account secure.
Disabling Access. We reserve the right, without liability, to disable your subscription and/or your access to the BecomingX Platform if you are in breach or we have reasonable grounds to suspect you are in breach of these Terms & Conditions or any other terms.
Commercial Use. You agree not to display, distribute, licence, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or upload for any commercial purposes, the BecomingX Platform or anything connected to your subscription of the BecomingX Platform.
PRICE AND PAYMENT
Subscription pricing. The pricing for the BecomingX Education subscriptions available is set out on the BecomingX.com website or as advised by our organisation. We take all reasonable care to ensure that the price of the BecomingX Education subscription advised to you is correct. It is always possible that, despite our best efforts, the BecomingX Education subscription pricing is incorrect. If the price you have been given is lower than the BecomingX Education subscription price which should apply we will contact you to inform you and you may terminate your BecomingX Education subscription and we will refund you any sums you have paid. If the price you have been given is higher than the BecomingX Education subscription price which should apply we will refund you the difference.
Payment Method and Payment Cycle. Direct debit is our preferred method of payment. We also accept most credit and debit cards. You may update your payment method at the time of renewal with our third party payment provider. We will take payment at or soon after the point that you register for your BecomingX Education subscription. Unless you cancel your BecomingX Education subscription before your next billing date, you authorise us to charge the BecomingX Education subscription fee for the next payment cycle to your payment method. You must ensure that you have a valid payment method prior to your next payment cycle. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your BecomingX Education subscription, we may suspend your access to the service until we have successfully charged a valid payment method. You are responsible for any charges such as foreign transaction fees or other fees relating to the processing of your payment method.
14 Day Cancellation Period. If you cancel your BecomingX Education subscription within the first 14 days and have not accessed any content or used any BecomingX Education subscription benefits we will provide you with a full refund. After the 14 day period you can cancel your subscription at any time (and any subsequent renewals), and you will continue to have access to the BecomingX Platform through to the end of your BecomingX Education subscription subscription period (e.g. 1 year). To the extent permitted by the applicable law, payments are non-refundable, and we do not provide refunds or credits for any partial BecomingX Education subscription periods. An administrator can cancel the account at www.becomingx.com.
Changes to BecomingX Education subscription pricing. We may change our BecomingX Education subscription plans and pricing from time to time; however, any plan or pricing changes will apply no earlier than 30 days following notice to you.
OUR RIGHTS TO END YOUR BECOMINGX EDUCATION SUBSCRIPTION OR ACCESS TO THE BECOMINGX PLATFORM
We may end your BecomingX Education subscription or access to the BecomingX Platform if you breach these Terms & Conditions or any other terms. If we reasonably believe that you have breached these Terms & Conditions or any other terms, we may immediately terminate your BecomingX Education subscription with you upon written notice and cease to provide you access to the BecomingX Platform and any benefits.
We may withdraw the BecomingX Platform. We may write to you to let you know that we are going to stop providing the BecomingX Platform. We will let you know at least one month in advance of our stopping the supply of the BecomingX Platform.
NO RESPONSIBILITY FOR ANY BENEFITS, SERVICES OR GOODS PROVIDED BY THIRD PARTIES
There are a number of benefits which are provided by third parties that are promoted on the BecomingX Platform. BecomingX has no control over any benefits provided by third parties and they may change at any time and without notice. The third parties are solely responsible for fulfilling any benefits, services or goods and it is your responsibility to ensure you enter into any contractual arrangements required with the third party. BecomingX is not an agent of any third-party provider. BecomingX makes no claims or promises with respect to any third party, including our information sharing partners or any businesses, partners or advertiser that you use in connection with your BecomingX Education subscription. Accordingly, BecomingX is not liable to you for any loss or damage that might arise from the actions or omissions of such third parties, including, for example, cancellation of any trips they have organised or any loss or injury that is incurred on any experience or trips.
OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU
We exclude all implied conditions, warranties, representations or other terms that may apply to your BecomingX Education subscription or the BecomingX Platform.

HOW WE MAY USE YOUR PERSONAL INFORMATION
We will only use your personal information you disclose to us in connection with your subscription to fulfil our obligations under these Terms & Conditions and as set out in our Privacy Policy.
OTHER IMPORTANT THINGS YOU SHOULD KNOW
We may transfer this agreement and your BecomingX Education subscription to someone else. We may transfer our rights and obligations in respect of your BecomingX Education subscription and these Terms & Conditions to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under these Terms & Conditions.
If a court finds part of these Terms & Conditions illegal, the rest will continue in force. Each of the paragraphs of these Terms & Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Even if we delay in enforcing these Terms & Conditions, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these Terms & Conditions, or if we delay in taking steps against you in respect of your breaking this Terms & Conditions, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you, but we continue to provide the BecomingX Platform, we can still require you to make the payment at a later date.
Which laws and jurisdiction applies to these Terms & Conditions. These Terms & Conditions are governed by English law and under the jurisdiction of the English courts.

When you use the BecomingX Platform and/or otherwise deal with us, we may collect the following information about you (Information):
Identity Data: first name, last name, date of birth and gender.
Contact Data: billing address, delivery address, email address and contact number.
Financial Data: payment method and card association used to process payments for services you order. We do not store or process your card details ourselves. They are processed and stored by one of our contracted third-party service providers. We encrypt payment-card details in your browser and securely transfer this data to Stripe, our third-party payment provider, to process a payment.
Transaction Data: details about transactions you have made using the BecomingX Platform, including payments from you or to you, and details of products you have purchased from us.
Profile Data: your username, login data, purchases or orders made by you, interests, preferences, feedback and survey responses.
Usage Data: information about how you use the BecomingX Platform, including browsing patterns, time spent on webpages, pages viewed, referring pages, clickstream data, page response times and page interaction information.
Marketing and Communications Data: your preferences for receiving marketing from us and your communication preferences.
Other Information: any other information relevant to services, customer surveys and/or offers.
All personal information that you provide to us must be true, complete and accurate. You must notify us of any changes to your Information.

Contractual purposes: to enable orders for products or services in connection with the BecomingX Platform to be fulfilled.

If you have given consent to marketing, we may contact you about our products, services, promotions and special offers. If you no longer wish to receive such information, you can withdraw your consent at any time by unsubscribing from the communications or emailing privacy@becomingx.com.
If you have given consent, we may share your Information with carefully selected third-party organisations and business partners, and they may contact you directly. If you prefer not to receive direct marketing communications from a third party, please contact them directly to withdraw your consent.
Although our education products are designed to be used with children, the BecomingX Platform is targeted at general audiences, educators and businesses. It is not targeted at children under 13, and children under 13 are not permitted to register to use the BecomingX Platform.
We do not knowingly collect personal data from children under 13 and have safeguards in place to reduce the risk of this occurring. If you become aware that a child has provided us with personal data without parental consent, please contact us at privacy@becomingx.com. If we become aware that a child under 13 has provided us with personal data without parental consent, we will take reasonable steps to remove that information and terminate any account created by the child as soon as possible.
As a provider of surveying and reporting capabilities to our customers, we recognise that education customers may administer surveys to students under 16 and under 13. In this instance, BecomingX acts as a processor of the data on behalf of its customers. Customers who administer surveys in their organisations are responsible for complying with applicable data protection law and obtaining any consents required by law.
BecomingX designs surveys to limit risk to child respondents and support a trusted relationship between customers administering surveys, respondents and BecomingX. Specifically, we:
provide guidance to customers on the importance of following relevant data protection laws and guidance when administering surveys to children;
provide age-appropriate messaging so that children completing surveys understand their purpose and how the information they provide will be used;
seek to limit the information captured. Unless explicitly needed or requested, our surveys do not capture the following data from children:
name;
day of birth, other than month and year; or
contact information, such as email address, phone number or address;
may suppress or aggregate information provided to customers if we believe it could identify an individual.
For legitimate educational, research or business purposes, BecomingX may use data from surveys that includes data provided by children. In these circumstances, we make the following commitments:
We will not use or share data beyond that required for educational, research or legitimate business purposes.
Any data shared or published will not be personally identifiable and will be anonymised or aggregated, unless explicitly requested or authorised.
We will never sell your Information.

We will maintain a comprehensive security programme reasonably designed to protect the security, privacy, confidentiality and integrity of children’s personal information.

Whenever we transfer your Information outside the UK, we will ensure that appropriate safeguards are in place in accordance with applicable data protection law. The BecomingX Platform may integrate with social sharing features or related tools that allow you to share actions you take on the BecomingX Platform with other apps, websites or media, and vice versa. These features may enable the sharing of information with your friends or the public, depending on the settings you establish with the relevant social-sharing site.
For example, you may click on a Facebook “like” button, which publishes to your Facebook account that you “like” content featured on the BecomingX Platform. These features may collect your IP address, the page you are visiting on the BecomingX Platform, and may set a cookie to enable the feature to function properly.
Your interaction with these features is governed by the privacy policy of the relevant social-sharing site. We cannot control the information or content you choose to make available publicly or how it is used by others.
You may terminate your account by requesting its deletion from the BecomingX Platform.
